Hadiel Hussien

Hadiel is a senior associate in our litigation practice, based in our DIFC office in Dubai.

Having completed the prestigious University of Sorbonne’s Bachelor of Law degree, Hadiel joined our litigation practice in 2014. She specializes in handling litigation and alternative dispute resolution matters. In her current role, Hadiel has cultivated legal skills and knowledge across various domains, including real estate, rental, banking and finance, employment, construction, commercial, and debt recovery disputes.

Fluent in English, Arabic and French, Hadiel is responsible for liaising with the legal departments of multinational companies. She consistently provides analytical and pragmatic legal advice tailored to each client’s specific requirements, offering insights into local laws and regulations and their implementation.

Hadiel has successfully concluded numerous settlements between disputing parties, provided pre-litigation advice, and crafted bespoke strategies to ensure positive resolutions, always striving to avoid litigation whenever possible.

Beyond her primary practice, Hadiel holds a special interest in Corporate Social Responsibility (CSR) practices. Actively participated in pro-bono legal clinics, she has also contributed to the legal framework, internal policies, and corporate governance of a recently established national fund overseeing CSR practices and contributions in the UAE.

• Advised on and concluded a settlement for the recovery of an AED 2 billion syndicated loan for two UAE banks and handled enforcement of settlement through Dubai Courts.
• Advised on complex sale transaction of hotel encumbered with mortgage and court seizure order and advised on transition of ongoing agreements.
• Advised a regional cinema operator in financial distress on legal recourses, including restructuring financial liabilities, re-negotiating long-term lease agreements, and employee termination.
• Devised a litigation strategy for a UAE bank regarding facility documents and enforcement of related securities, with a comparative analysis of jurisdictional options and applicability of foreign vs local
• Co-counselled on a DIAC arbitration case involving a construction dispute, providing strategic advice on tribunal submissions and expert reports.
• Advised a steel and profile insulation industry group on restructuring AED 4 billion debt and identified regulatory violations by the bank.
• Handled a cross-border litigation regarding enforcement of a foreign judgment from the Democratic Republic of Congo in a dispute over ownership of a large precious metals’ mining company.
• Advised recruitment services and manpower outsourcing companies on their legal and HR frameworks, including drafting of company policies and creation of template employment contracts, termination letters, notices, entry and exit handover lists and investigation minutes.
• Formulated a strategy for terminating hotel management agreement and regaining control over the hotel, while complying with the franchise agreement and advising on hotel ownership dispute between partners.
• Co-advised on arbitration proceedings for a contractor to claim unpaid dues exceeding AED 500 million including, EOT claims, variations, and non-certified claims.
• Handled employment dispute for USD 3 million and concluded settlement in favour of the former Group CEO against a giant global advertising and communications company.
• Advised an international manufacturer and supplier of electronic devices on the available avenues to initiate bankruptcy proceedings against one of its distressed debtors in the UAE.
• Advised a local real estate business on residential and commercial leases, which involved regularly drafting default and eviction notices and handling rental claims.
• Drafted and reviewed various types of agreements, including: (i) sale and purchase agreements, (ii) property management agreements, (iii) settlement agreements, (iv) product and service supply contracts, and (vi) employment contracts.
• Drafted bespoke legal advice and opinions relating to various contentious and non-contentious matters, including but not limited to: (i) employment, (ii) real estate, (iii) commercial debt recovery claims, (iv) commercial agencies, (v) legal ramifications of termination of civil/commercial contracts, (vi) foreclosure proceedings, (vii) analysis of jurisdictional challenges, (viii) enforcement of foreign judgments, and (ix) enforcement of arbitration awards.
